Product Liability Disclaimer

This Product Liability Disclaimer ("Disclaimer") applies to all products, including the Aftrak precision farming kits, supplied by Global Manufacturing Africa (Pty) Ltd ("GMA"). By purchasing and/or using GMA Products, the Customer acknowledges and agrees to the terms of this Disclaimer.

1. Limitation of Liability

• 1.1 GMA's total liability for any claim arising from or related to its Products shall not exceed the original purchase price paid by the Customer for the specific Product giving rise to the claim.
• 1.2 GMA shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to:
  • Loss of agricultural produce or farming income
  • Loss of profit, revenue, or business opportunities
  • Loss of data or information
  • Costs of substitute products or services
  • Business interruption losses
• 1.3 These limitations apply regardless of the legal theory under which the claim is brought (contract, delict, warranty, or otherwise).

2. No Liability for Misuse

GMA shall not be liable for any damage, injury, or loss arising from:

• Use of the Product in a manner not in accordance with GMA's instructions or specifications
• Modification, repair, or disassembly of the Product by any party other than GMA or its authorised agents
• Use of the Product in combination with third-party equipment or software not approved by GMA
• Failure to follow installation, operation, or maintenance instructions

3. Technology Disclaimer

• 3.1 GMA's products incorporate GPS, cellular, and sensor technologies. GMA does not warrant continuous or uninterrupted connectivity or data transmission; the accuracy of GPS positioning data in all environmental conditions; or compatibility with all third-party network or software systems.
• 3.2 GMA is not liable for data loss or service interruptions arising from telecommunications network failures, solar events, or other matters beyond GMA's reasonable control.

4. Agricultural Outcomes

• 4.1 The Aftrak system is a farming and mechanisation tool. GMA makes no warranty or guarantee regarding specific agricultural or productivity outcomes arising from use of the Product.
• 4.2 GMA is not liable for farm operational decisions made using data generated by the Product.

5. Applicable Law

• 5.1 To the extent that consumer protection legislation (including CPA 68 of 2008 or equivalent in the Customer's jurisdiction) implies warranties or limits exclusions that cannot be contractually waived, those provisions apply.
• 5.2 These limitations do not apply to liability for gross negligence or wilful misconduct by GMA.

6. Acknowledgement

The Customer confirms that they have read, understood, and accepted this Product Liability Disclaimer prior to or upon purchase of GMA Products.
